Pepper spray (OC spray) is legal for adults to carry in all 50 states — but several states restrict the size, concentration, or how you can buy it. Cross state lines without knowing the rules and you could unknowingly be committing a crime.

The Three Main Restrictions

Size / Weight Limits

Some states cap the canister at 2 oz, 2.5 oz, or 4 oz. Standard keychain pepper sprays (0.5–1 oz) are legal everywhere. Large "stream" models (4–6 oz) may be restricted in some states.

OC Concentration

Michigan caps OC at 2%. Wisconsin caps at 10%. Most states have no concentration limit. Standard civilian-grade sprays are 1–2% OC. Law enforcement grade is typically 10%.

Purchase Requirements

New York and Massachusetts require purchase from a licensed dealer. Connecticut requires a licensed dealer. Most states allow purchase anywhere — hardware stores, Amazon, sporting goods.

Felony / Criminal Record Restrictions

Every state prohibits convicted felons from carrying pepper spray. Many also extend this to people convicted of assault, domestic violence, or drug offenses. If you have a criminal record, verify your eligibility under your specific state law before purchasing.

Traveling Between States

The safest rule: carry the most restrictive state's allowed product. A standard 1-oz keychain spray with 1–2% OC is legal in all 50 states. If you're traveling through Massachusetts or New York, you technically need to have purchased from a licensed dealer in that state — purchasing online for shipment to those states may be restricted. The practical risk for a traveler passing through is minimal, but worth knowing.

Frequently Asked Questions

Can I buy pepper spray on Amazon if I’m in a restricted state?

Amazon restricts shipment of pepper spray to Massachusetts and New York — the two states with licensed-dealer purchase requirements. Many sellers also restrict shipment to Hawaii. For all other states, you can purchase pepper spray online and have it shipped to your home.

What’s the difference between OC, CS, and CN spray?

OC (Oleoresin Capsicum) is made from hot peppers — it causes intense burning and inflammation. It works on most people including those under the influence of alcohol or drugs. CS ("tear gas") and CN (Mace, the original formula) are chemical irritants that primarily affect tear ducts and mucous membranes. Most consumer products today are OC-based. Some states restrict CS and CN more than OC. For self-defense, OC is the most reliable and widely legal option.

Can I carry pepper spray on a plane?

Not in carry-on luggage. The TSA allows one 4-oz container of OC pepper spray in checked baggage only — it must have a safety mechanism to prevent accidental discharge. No pepper spray allowed through security checkpoints.
